The Dubai company’s request for a sum of US$ 50,000.00 from a Sri Lankan company has been rejected.

A lawsuit was filed by a Dubai-based company, Euro Capital, against two Sri Lankan businessmen, Jicker Cassim and his son Mohamed Shakeel Cassim. The company sought to recover a sum of US$50,000.00 from the defendants under a trade finance agreement. Euro Capital claimed that the dispute arose from the supply of goods to the defendants.

The plaintiff initiated legal proceedings based on an agreement entered into between the company and the two defendants. They alleged that they had provided trade services and finance facilities to the defendants for their business activities.

However, the judge noted that although the plaintiff’s witness testified that the goods were purchased at the defendants’ request, no documentary evidence was presented to support this claim. As a result, Judge Pradeep Hettiarachchi dismissed the plaintiff’s case.

Representing the plaintiff company were President Counsel Ikram Mohamed and Ms. Dilini De Alwis, instructed by Julius and Creasy. President Counsel S.K. Parthalingam, along with A.A. L.Iliyas PC, instructed by Nithi Murugesu and Associates, appeared on behalf of the defendants.
